الإرادة الوقفية وأثرها على التصرف في الوقف

إن الإرادة الإنسانية تعد الموجه الرئيس لعمل الإنسان، وعليها يکون الثواب والعقاب، والوقف أحد المظاهر المهمة للتعبير عن إرادة الواقف؛ لأن الوقف من أفضل أعمال القربات؛ فثوابه مستمر حتى بعد وفاة الواقف، والأصل في شرط الواقف أنه واجب الاتباع؛ لأن الواقف تبرع بالمال على وجه مشروط، فکان له شرطه، ووجب اتباعه،فمن المؤکد أن شرط الواقف يعبر عن إرادته من الوقف، والأصل أن التصرف في الوقف مقيد بما أراده الواقف من وقفه، فلا يجوز إغفال إرادته، ويشمل ذلک جميع التصرفات الوقفية، کتعيين الموقوف عليهم ، ونظارة الوقف، وکيفية توزيع الأموال الوقفية ، وتوزيع عوائد الوقف ، وإمکانية استثمار أموال الوقف، وصيانة الوقف إذا احتاج إلى صيانة ،أو بيعه واستبداله متى کانت المصلحة في ذلک ،مع مراعاة عدم الجمود والتمتع بقدر من المرونة عند تفسير إرادة الواقفين متى تطلبت المصلحة الشرعية العامة للوقف مرونة في تفسير تلک الإرادة، بما يحقق مصلحة المنتفعين بالوقف، وضمان بقاء العين الوقفية ، ولا يصطدم بإرادة الواقفين.
