أثر حظر التجوال على أداء العبادات دراسة فقهية

يتناول هذا البحث دراسة نازلة فقهية تتجدد مع تجدد أسبابها ألا وهي حظر التجوال والتنقل في أوقات معينة بأمر من الحاکم وکل من له سلطة بالبلد لأسباب صحية وهو الخوف من انتشار العدوى من بعض الأمراض والأوبئة والفيروسات المعدية، أو لأسباب أمنية بسبب حدوث اضطرابات ومشاکل أمنية أو في زمن الحروب والقلاقل، ولا شک أن لهذا الحظر أثر ملموس على عبادات المسلم، ونظراً لأهمية هذا الموضوع، والحاجة الماسة إلى معرفة الأحکام الشرعية في تلک الفترات، کانت هذه الدراسة المعنونة بـــ" أثر حظر التجوال على أداء العبادات – دراسة فقهية-". وتهدف الدراسة إلى بيان مفهوم حظر التجوال، ومعرفة أسبابه، وبيان مدى تأثير حظر التجوال على أداء العبادات التي تتطلب من المسلم أداءها خارج مسکنه، وقد تناولت مسائل هذا البحث في أربعة مباحث، تسبقهم مقدمة وتمهيد، وتعقبهم خاتمة بأهم النتائج ومنها: الراجح أن صلاة الجمعة و الجماعة تسقط بعذر الخوف، وعليه فتسقط بحظر التجوال، جواز تأخير تجهيز الميت لحظر التجوال، إذا لم يترتب على ذلک تغير للجثة، وجواز ترک صلاة الجنازة على الميت، والاکتفاء بفرد واحد يصلي عليه من أجل حظر التجوال، وأيضاً أن حظر التجوال يعد من أنواع الإحصار الذي يمنع من أداء مناسک الحج أو العمرة؛ لأن الإحصار يکون بأي سبب مانع کالعدو، والمرض، ومنع التنقل بأمر من الحاکم وغير ذلک من الأعذار التي تحول بين الإنسان وبين نسکه.

There is no doubt that this ban has a tangible effect on Muslim worship, and given the importance of this topic, and the urgent need to know the legal rulings in those periods, this study was entitled “The effect of the curfew on the performance of ritual acts - a jurisprudential study -”. The study aims to clarify the concept of curfew, to know its reasons, and to indicate the extent of the effect of the curfew on the performance of the rituals that require a Muslim to perform them outside his home, and the issues of this research were dealt with in four sections, preceded by an introduction and preface, and followed by a conclusion with the most important results, including: It is more likely that the Friday prayer The group falls under the excuse of fear, and therefore it falls under the curfew, the permissibility of delaying the preparation of the dead for the curfew, if this does not lead to a change in the body, and it is permissible to leave the funeral prayer for the dead, and to be satisfied with one person who prays for the sake of the curfew, and also that the curfew is one of the types The blockade that prevents the performance of Hajj or Umrah rituals; Because the blockade is for any reason such as an impediment, such as enemy, disease, preventing movement by order of the ruler and other excuses that prevent a person from his asceticism.
