يعتبر موضوع الإثبات القضائي هو صلب علم القضاء وقوامه، فلا حق مأخوذ ولا ظلم مردود إلا ويسبقهما ما يثبتهما أو يسقطهما، کما أنه لا يتم واجب العدل الذي أمرنا به إلا بفطنة هذا العلم ومعرفة دقيق مسائله، قال تعالى: (إن الله يأمر بالعدل والإحسان) هذا وإن من وسائل الإثبات التي کثر الکلام عليها قديما وحديثا، إعمالا وإهمالا قبولا وردا  (القرائن)، نبحث في هذه الورقات موضوعا متصلا بهذه الوسيلة، وهو مدى إمکان تنزيل هذه القرائن منزلة المخبرين من حيث المدرک، وما تفيده هذه القرائن، في المقام الأول على مستوى الدرس الأصولي ومدى اتصال هذه الوسيلة بتقرير مباحث الأخبار في المدونات الأصولية، لننظر ما ترکت لنا تلک المدونات في هذا الجانب، وفي المقام الثاني نحاول بحث (القرائن) من خلال علم الإثبات القضائي، ومدى تأثيرها في المجال القضائي، لننظر في مدى حجيتها وصلاحيتها للإثبات من عدمها، فلا شک أن الشهادة في القضاء تتداخل مع الأخبار عند الأصوليين في کثير من الأمور وإن اختلفت في أخرى وبين هذا وذاک نبحث ما يتصل بهاذين الأصلين على سبيل الإيجاز، بما يتناسب مع مجال هذه الأبحاث القصيرة.
