المستخلص

فإن اللفظ له أثره في الدلالة على الحکم الشرعي، وتظهر أهميته مما قد يتعلق بالعبد من إبراء ذمته في أداء الواجبات، ويهدف هذا البحث إلى بيان أثر دلالة اللفظ على الحکم الشرعي وکذا أثرها على النظام السعودي. ويظهر من نتائج هذا البحث: أن الدلالة اللفظية تعتبر أن اللفظ إذا أطلق فُهم منه المعنى المراد، واللفظ الصريح يثبت به الحکم الشرعي دون التوقف على النية بخلاف اللفظ الکنائي. وکذلک اللفظ النظامي تعتبر تعبيراً عن إرادة المنظم ودلالته هي المرجع الأول في معرفة مراد المنظم ويجب استحضار هذه النية عند التطبيق العملي.
 
Abstract:
The word has its effect on the indication of the legal ruling, and its importance is evident from what may be related to the slave discharging him from performing his duties, and this research aims to show the effect of the meaning of the word on the legal ruling as well as its impact on the Saudi system. It appears from the results of this research: that the verbal indication considers that the word, if the meaning of it is intended to be understood, and the explicit word proves the legal ruling without stopping on the intention other than the kinetic word. Likewise, the regular word is considered an expression of the will of the regulator and its significance is the first reference in knowing the intention of the regulator, and this intention must be evoked in practice.
